These Terms of Service (“Terms”) govern your use of the MapX platform, websites, and services (the “Service”) provided by MapX (“MapX”, “we”, “us” or “our”).
By creating an account, clicking “I agree”, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation and “you” refers both to you personally and the organisation.
1. The Service
MapX is a software-as-a-service platform for creating, distributing, and analysing map-based surveys. We provide tools to build surveys, collect responses, visualise results on maps and dashboards, and export data.
2. Your account
2.1 You must provide accurate, current and complete information when creating an account and keep it up to date.
2.2 You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@mapx.se of any suspected unauthorised use.
2.3 You must be at least 16 years old (or the age of digital consent in your country) to use the Service on your own behalf.
2.4 Organisational accounts use company workspaces with role-based access (Owner, Admin, Member, Viewer). The Owner is primarily responsible for the organisation’s use of the Service.
3. Plans and billing
3.1 MapX offers Free, Pro, and Enterprise plans. Features and usage limits for each plan are described at sign-up or in your workspace.
3.2 Paid plans are billed in advance on a recurring basis. You authorise us or our payment processor to charge your designated payment method for each billing cycle.
3.3 Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for any applicable VAT or sales tax.
3.4 Unless otherwise required by law, fees are non-refundable. You may cancel at any time through your account settings; your plan will remain active until the end of the current billing period, and no refund is provided for partial periods.
3.5 We may change pricing with at least 30 days’ advance notice, applying at the next renewal.
4. Acceptable use
You agree not to:
- Use the Service to violate any applicable law or the rights of any person;
- Collect, store, or process personal data through the Service without a valid lawful basis under applicable privacy laws;
- Run surveys designed to harass, defame, discriminate against, threaten, or deceive any person or group;
- Upload or distribute content that is illegal, infringing, defamatory, obscene, hateful, or contains malware;
- Attempt to gain unauthorised access to the Service, other users’ data, or the underlying infrastructure;
- Interfere with, disrupt, probe or reverse engineer the Service, or circumvent any security features;
- Scrape, crawl, or extract data from the Service except through features we provide;
- Use the Service to send spam or unsolicited commercial communications;
- Use automated methods to create accounts or submit responses;
- Resell, sublicense, or make the Service available to third parties outside your organisation without our written permission;
- Use the Service to build a competing product or to benchmark it in bad faith.
Violation of this section may result in immediate suspension or termination.
5. Your content
5.1 Ownership. You retain all rights to the surveys, questions, images, documents, and other content that you upload or create in the Service (“Your Content”). You also retain rights to responses collected through your surveys, subject to the terms of your own privacy notice and the rights of respondents.
5.2 Licence to us. You grant MapX a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting and display), transmit, and display Your Content solely to operate, secure, and improve the Service and to provide it to you and users you designate. We do not use Your Content to train our own or third-party AI models.
5.3 Respondent data and your role as controller. When you use the Service to collect responses, you act as a data controller and MapX acts as a data processor on your behalf. You are solely responsible for:
- Establishing a valid legal basis under GDPR or other applicable laws;
- Providing respondents with a clear privacy notice;
- Respecting respondent rights (access, erasure, etc.) and forwarding any requests to us so we can assist;
- The content of your surveys — including any questions that may elicit special-category data, precise location data, or personal data of minors;
- Configuring retention and deletion of responses in line with your legal obligations.
5.4 Removal. You can delete Your Content from the Service at any time. On deletion, we remove it from active systems within a reasonable period and from backups in the ordinary course of rotation.
6. AI features
6.1 The Service includes AI-powered features — including AI survey generation, AI analysis dashboards, and chat — powered by Anthropic’s Claude models.
6.2 When you use an AI feature, your inputs (prompts, selected survey content, uploaded documents) are transmitted to Anthropic for inference and returned as outputs. Anthropic does not use this data to train its models.
6.3 AI outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing outputs before relying on them, publishing a generated survey, or acting on an AI-generated summary. Nothing the AI produces is professional advice.
6.4 We may limit, meter, or discontinue AI features at our discretion, including to manage cost or prevent abuse.
7. Third-party services
The Service integrates third-party services including map tiles and directions from Mapbox and authentication and infrastructure from Google Firebase. Your use of those services through MapX is also subject to their terms, including Mapbox’s Terms of Service and Google’s Cloud Platform / Firebase terms. We are not responsible for third-party services beyond our own use of them.
8. Intellectual property
8.1 The Service — including its software, design, trademarks, documentation, and aggregated usage data — is owned by MapX and its licensors and is protected by intellectual property laws.
8.2 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes during the term of your subscription.
8.3 Feedback. If you provide us with feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use it without obligation to you.
9. Confidentiality
Each party will protect the other’s confidential information with at least reasonable care and use it only to perform these Terms. Your survey content and response data are treated as confidential. The obligations in this section do not apply to information that is public, independently developed, or required to be disclosed by law.
10. Service availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may perform scheduled maintenance and make changes to the Service. We will use reasonable efforts to provide advance notice of material changes that reduce functionality.
11. Suspension and termination
11.1 You may terminate your account at any time by cancelling in your account settings.
11.2 We may suspend or terminate your access immediately if:
- You materially breach these Terms or our Acceptable Use Policy;
- You fail to pay amounts when due after reasonable notice;
- We reasonably suspect fraudulent or illegal activity;
- We are required to do so by law.
11.3 On termination, your right to use the Service ends. We will make a reasonable effort to allow you to export Your Content for 30 days after termination, after which we may permanently delete it.
12. Warranty disclaimer
Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements or that it will be uninterrupted, secure, or error-free.
Nothing in these Terms excludes or limits any rights you have under mandatory consumer law.
13. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, loss of business, loss of data (other than as required by our data-protection obligations), or loss of goodwill.
- Each party’s total aggregate liability under these Terms is limited to the amounts paid by you to MapX in the twelve (12) months preceding the event giving rise to the claim, or EUR 100 if no amounts have been paid.
These limitations do not apply to (i) either party’s gross negligence or wilful misconduct, (ii) your payment obligations, (iii) your breach of the Acceptable Use Policy, (iv) indemnification obligations, or (v) liability that cannot be limited by law.
14. Indemnification
You will defend and indemnify MapX and its officers, employees, and agents against any claim, demand, or liability arising from:
- Your Content or your surveys, including any violation of privacy law;
- Your use of the Service in violation of these Terms or applicable law;
- Your infringement of a third party’s rights.
MapX will defend and indemnify you against third-party claims that the Service, as provided by us, infringes that third party’s intellectual-property rights, subject to customary conditions (prompt notice, cooperation, and control of defence).
15. Governing law and disputes
These Terms are governed by the laws of Sweden, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be submitted to the exclusive jurisdiction of the courts of Stockholm, Sweden, unless mandatory consumer-protection laws in your country of residence provide otherwise.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated at least 30 days in advance by email or in-product notice. Your continued use of the Service after changes take effect constitutes acceptance.
17. General
- Entire agreement. These Terms (together with any order forms) are the entire agreement between the parties regarding the Service.
- Severability. If any provision is held unenforceable, the remainder of these Terms remains in effect.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Notices. We will send notices to the email address on your account. You may send notices to support@mapx.se.
- Force majeure. Neither party is liable for failure to perform due to causes beyond reasonable control.
